Strategy Package Terms & Frequently Asked Questions
Strategic Advisor Package Terms & Conditions:
These Strategic Advisor Package Terms and Conditions (“Conditions”) apply to all Strategic Advisor packages I offer. Do not let the format confuse you – sometimes the best way to explain a “condition” is by FAQ. The following FAQs constitute part of the “Conditions” as much as the text you will see in typical legal format.
Am I Hiring a Lawyer?
Yes, Brock Shinen, is a lawyer licensed to practice law in the state of California.
Is Brock Shinen my lawyer?
NOT because of you hiring him as a Strategic Advisor. I want to make clear that when hiring me as a Strategic Advisor, you are NOT hiring me as your lawyer. My Strategic Advisor services are focused on strategy and implementation, not legal representation. If you need legal representation, please contact the Law Office of Brock Shinen, Inc.
What’s included in my Strategic Advisor package?
Each Strategic Advisor package explanation defines the pieces of that package, but the idea is to keep the relationship flexible in order to allow the Strategic Advisor and client to make the best use of time. “Weekly telephone calls” might mean one day per week, or three days per week, depending on my assessment of the best use of time. Likewise, the time periods described in each Strategic Advisor package are also intended to serve as generalized markers, and not necessarily serve as explicit benchmarks. “Week 1,” for example, might be 4 days or 10 days, depending on how we work together. “Weekly email access” also has inherent limitations. I will not, for example, respond to every single email sent in a one-week period. Rather, we start with the idea that you can email me each week, and that may be one email or it may be several. Of course, a few clients have attempted to abuse the open-ended description, which is why I always leave the determination in my sole discretion. You may send emails to me on a weekly basis (if your package includes that option). I may not respond to each and every email, but I will respond in general to the nature of your weekly emails.
What about “Unlimited Emails”?
Unlimited means without limit so long as the number is reasonable. Does that mean an email every day? Possibly. Does it mean multiple emails every day? No. If it is necessary for you to email me every day, chances are, you have enough money to pay for the highest package, but lack the competence to deal with normal business activities. For that reason, it would be better for me to actually limit your access specifically in order to help train you to become more independent. Thus, I reserve the right to limit “unlimited” email access based on my assessment of the reasons for your emails. Regardless of the amount of emails you send, I may not respond to all of them.
What’s the “Monthly VIP Mastermind Call”?
It is an audio or video call scheduled once per month. It lasts approximately one hour, depending on participation and my schedule. People invited to the call are typically entrepreneurs, business owners, high-level managers, creators, and others who take their life and business serious and want an opportunity to bounce things off of each other and off of me. I can’t guarantee who will participate, so there are times when it’s just me and one other person. Other times, it might be a group of 5, 10, or even 20 people. I will try to limit the attendance if I feel it is too cumbersome to be meaningful. Scheduling is usually systematic (i.e., the first Monday of the month) or based on the flow of Strategic Advisor clients. Calls are recorded, so if you miss a call, you are able to request access to the recording.
What’s the “Private VIP Facebook Group”?
It’s an invite-only group on Facebook where you can share, learn, and grow. The group is designed to create a community of like-minded people who support and encourage each other. I reserve the right to edit content and remove people from the group for activities such as illegal conduct, harassment, unreasonable self-promotion, and similar issues.
Will you draft or review contracts as part of the Strategic Advisor service?
No. Drafting and reviewing contracts is most likely construed as the practice of law. If you need that type of activity, reach out to my law firm.
Does Strategic Advisor include representation in mediation, arbitration, or in court?
No. Those things are also most likely the practice of law, and I handle those areas in my law practice.
I’m sure you don’t know everything – what areas can I expect to cover in the Strategic Advisor program?
Excellent point. Here are the typical areas I cover:
- Business strategy
- conflict resolution
What if I’m not happy with how things are going?
In over 13 years as a working professional, I’ve learned many valuable lessons. One is that exploring the tricky areas of risk and opportunity often leads to fear, frustration, and/or confusion. This can easily translate to a client wanting to run the opposite direction or blame someone. I have spent many years and countless hours developing my knowledge and expertise, and I have never once had a client ask for a refund after I rendered a service. My general rule is that there are no refunds. I deliver quality services. However, if you are not happy with how things are going, let’s talk. Tell me why you are not happy. If it’s because I am not doing a great job in a way I said I would, I might consider a refund. There are many factors to consider, so I can’t say that I will. On the other hand, if you aren’t happy and I realize it’s because you’re actually mad at me for pointing out some truth in your circumstances or you’re not willing to put in the work, I wouldn’t be helping you by refunding you anyway. So, that’s my policy- no refunds, except in very rare circumstances, in my sole discretion.
Any other “fine print”?
